I have collision coverage for my auto insurance here in Texas so I’d just file a claim to my own insurance provider to cover the damages on my car since the at-fault driver’s insurer denied my claim. They are saying that the accident wasn’t the other driver’s fault, what can my insurer do about that? Also, will my premiums go up even though the accident was not my fault?

You still need to pay the deductible on your collision coverage in case you have gotten into a vehicular accident that you did not cause which involves another car and you file a claim on your auto insurance policy to cover the damages on your car. However, if the other driver was really the one who caused the accident, your auto insurance provider in Texas would go after the other driver’s insurance company to recover their payment for the damages on your car as well as for the deductible that you paid. Your auto insurance provider will also let you file a claim under your uninsured motorist coverage provided that you have this in your policy. But in most states, uninsured motorist coverage would only cover the payment for injuries.

Your auto insurance rates will not essentially go up during the renewal period once you file a claim under your insurance policy because of an accident that you did not cause. Most state insurance regulations forbid car insurance providers from adding on charges or increasing their premiums for accidents wherein they were not at-fault. But these regulations don’t prevent your car insurance provider to drop your policy once it’s up for renewal in case you have filed so many recent claims. Also, if you drive in a high risk neighbourhood and are prone to being hit, even if you were not the one who caused it, your car insurance provider may find you so risky to insure.
